Terms & Conditions of Service
QUICK SUMMARY

You own your website and content completely. We do not host your site (unless specified); we optimize it using AI and data. We guarantee the availability of our Dashboard/AI. Payment is non-refundable once the audit/optimization has begun. You are responsible for approving changes. We are not liable for search engine ranking fluctuations. You can cancel anytime.

These Service Terms (“Terms”) form a binding agreement between Starter WP, Inc., a Delaware corporation (“Starter WP,” “we,” “us,” or “our”), and each paying customer (“Client,” “you,” or “your”) who purchases website optimization services through our platform at starterwp.com (the “Site”). By completing checkout, you agree to these Terms.
1. Scope of Services
Starter WP provides AI-driven website optimization services, including:
- Website Audits: Automated analysis of site structure, content, and SEO.
- Optimization Roadmaps: Prioritized recommendations to improve conversion rates.
- Implementation Services: (Performance Tier Only) Technical execution of recommendations.
- Reporting: Data regarding traffic, behavior, and competitive landscape.
Starter WP is not a hosting provider (unless a separate legacy hosting agreement is signed) and does not claim ownership of your website infrastructure.
2. Project Timeline & Onboarding
Services begin immediately upon signup ("Day 1").
- Day 1: Automated Audit and initial Roadmap generation.
- Day 7: First round of behavioral data analysis and optimization recommendations.
- Ongoing: Weekly analysis cycles recur every 7 days.
3. Payments and Billing
3.1 Optimization Service Tiers
Client selects one of three tiers at signup:
LAUNCH TIER ($119/month or $1,188/year):
- Weekly AI-generated optimization recommendations
- Client implements changes independently (DIY)
- 24/7 AI assistant for copy/strategy help
- Basic email support
GROWTH TIER ($239/month or $2,388/year):
- Everything in Launch +
- Monthly Executive Brief (Reporting & Strategy)
- Advanced AI Analytics (Predictive insights)
- Client implements changes independently (DIY)
- Priority email support
PERFORMANCE TIER ($479/month or $4,788/year):
- Everything in Growth +
- Done-For-You Implementation (Starter WP executes approved fixes)
- Quarterly Strategy Calls
- Dedicated Account Contact
3.2 Billing Terms
- All prices in USD.
- Annual Billing: Paid upfront. Provides ~17% discount vs. monthly rates.
- Monthly Billing: Paid on the same day each month.
- Automatic renewal unless cancelled.
- Late payment: Service suspended immediately upon failed payment.
4. Refunds, Cancellations, and Termination
4.1 Refunds
Due to the immediate costs of the initial Audit and AI Setup, refunds are not provided for the initial month or annual term once the Day 1 Audit has been delivered. We do not offer pro-rated refunds for unused time on Annual plans.
4.2 Client-Initiated Cancellation
- You may cancel anytime via your dashboard or by emailing support.
- Services continue until the end of your current paid billing period.
- Upon cancellation, we stop monitoring and optimizing your site. You retain all changes made up to that point.
4.3 Termination
Starter WP may terminate service immediately if Client's website is found to contain illegal content, malware, or violates our Acceptable Use Policy (Section 8).
5. Hosting and Infrastructure
We do not host your website. You are responsible for maintaining your own hosting, domain registration, and website uptime. Starter WP is not liable for your website going offline.
Service Availability: We guarantee 99.9% uptime for the Starter WP Dashboard and Reporting tools. If our application is offline, we will issue service credits upon request.
6. Access and Ownership
You Own Everything. Starter WP claims no ownership over your website, domain, content, or design.
Optimization Data: You own the reports and roadmaps we generate for you. We retain the right to use anonymized data (e.g., "Traffic increased by 20%") for aggregate benchmarking and marketing.
Access Credentials: To provide our services, you may grant us access (via plugin, API, or login) to your website or analytics. We store these credentials securely and use them solely for optimization purposes.
7. Implementation & Liability (Performance Tier)
For clients on the Performance Tier, Starter WP will implement changes to your live site.
a) Approval: We will not publish changes without your approval (active or passive approval settings as configured in your dashboard).
b) Backups: While we take precautions, Client is responsible for maintaining a recent backup of their website before authorizing us to implement changes.
c) Liability: Starter WP is not liable for temporary display issues, plugin conflicts, or downtime resulting from the implementation of approved optimizations. If a change breaks the site, our sole obligation is to revert the change to the previous state.
8. Client Responsibilities
You agree to:
a) Provide a legitimate business website.
b) Ensure your content complies with all applicable laws (GDPR, FTC, etc.).
c) (For Launch/Growth Tiers): You acknowledge that you are responsible for implementing the recommendations. Starter WP is not responsible for lack of results if recommendations are not implemented.
9. Service Availability and Warranty
Services are provided “as is” without warranties of any kind.
9A. Limitations on AI Recommendations
Client acknowledges that:
a) No Ranking Guarantee: Search engines (Google, etc.) change algorithms frequently. Starter WP does not and cannot guarantee specific rankings, traffic numbers, or business revenue.
b) AI Limitations: Recommendations are generated by Artificial Intelligence. While human-reviewed, they may occasionally require context that only you possess. You are responsible for final approval of all content.
10. Limitation of Liability
To the fullest extent permitted by law, Starter WP's total aggregate liability shall be limited to the amount you paid for services in the 3 months preceding the claim.
Starter WP is not liable for:
- Loss of revenue, profits, or business opportunity.
- Ranking drops or SEO penalties.
- Data loss (Client is responsible for hosting/backups).
11. Privacy and Data
We take data privacy seriously. Our use of your data is governed by our Privacy Policy.
Confidentiality: We will not share your specific traffic data, leads, or strategies with your competitors.
12. Governing Law
These Terms are governed by the laws of the State of Delaware, U.S.A. Disputes shall be resolved via binding arbitration.
